SPECIAL REPORT: Paigtingin ang Kaligtasan ng Pampublikong Sasakyan


Gaano kaligtas ang mga sasakyang pampubliko sa Pilinas? At sino ang dapat managot sa mga biktima ng trahedya o disgrasya sa public transport lalo na kung may naganap na kapabayaan mula sa panunuan nito?

Kamakailan, umani ng batikos ang MRT sa disgrasyang kinasangkatutan ng maraming bata at kanilang mga ina at senior citizens. Bunsod ito ng pagtulak sa bagon ng MRT na nasira sa Magallanes station. Upang hindi maantala ang operasyon ng MRT  kinailangan itulak ang bagon ng isang pang unit ng MRT train. Sa kasamaang palad ay humiwalay ang pagkakarugtong ng dalawang tren sanhi upang dumeretso ang sirang bagon at lumampas ito sa riles na hangganan ng MRT station sa Pasay.

Sa lakas ng impact ng tren marami ang tumilapon sa loob ng tren,naumpog at nasugatan. Salamat at walang binawian ng buhay sa aksidente at sinagot  naman ng pamunuan ng MRT ang naging gastusin ng mga biktima sa ospital.
Sa mga nagdaang buwan at araw, samu’t saring aksidente naman sa bus ang naganap tulad ng pagkakahulog ng bus sa Magallanes flyover. Sinundan pa ito ng Florida transit na nahulog din sa bangin sa Mt. Province na ikinasawi ng marami kabilang ang character actor na si Tado.

Hindi rin pahuhuli ang mga sasakyang pandagat kung trahedya ang pag-uusapan. Una na sa listahan ang Sulpicio Lines Inc. (SLI). Kasalukuyang isinusulong ng Public Attorneys Office sa pamumuno ni Chief Persida Acosta ang laban ng mga kaanak ng biktima ng lumubog na MV Princess of the Stars.
August 11 nang mag martsa sa Supreme Court sa Maynila ang mga kaanak ng mga biktima upang mag- file ng motion for consideration para sa criminal liability ng may-ari nito, ang SLI.

Sinamahan sila ng pamunuan ng PAO, ni forensic expert Dr. Erwin Erfe at running priests Fr. Robert Reyes, at ilang miyembro ng media .
Lumubog ang MV Princess noong June 22, 2008 sa Sibuyan Island sa Romblon matapos itong iwasiwas sa dagat ng bagyong Frank.
Sa 860 na nakalistang pasahero,  52 lamang ang nakaligtas.  At kahit anim na taon na ang nakalilipas, patuloy pa rin PAO forensic team sa pagkalap skeletal remains ng mga biktima “despite logistics problems and with only the local coast guards helping them,” ayon kay Dr. Erfe.

At the time of her sinking, the MV Princess of the Stars was the largest passenger ship in the Philippines.

Wala pang nareresolba sa mga kasong isinampa laban sa Sulpicio Lines at kahit patung-patong ang mga kaso laban dito, pinayagan pa ito ng Marina na magpalit ng pangalan – ito na nga ang Philippine Span Asia Carrier Corporation (PSACC) – at patuloy na nagnenegosyo.
In short, SLI or now PSACC still holds an infamous record of maritime safety. Ang iba pang mga barko nito na kasama sa  sea disasters ng bansa ang MV Doña Paz (1987),  MV Doña Marilyn (1988), at MV Princess of the Orient (1998).

Ayon sa record, more than 4,000 people died in the MV Doña Paz tragedy alone.

On August 4, the Supreme Court affirmed  the decision of the Court of Appeals clearing Edward Go, Vice President for Administration of  SLI from criminal liability over the sinking of MV Princess of the Stars.
Ang resolution na sinulat at pinirmahan ni Associate Justice Estela Perlas-Bernabe ay nagsasabing “the liability of Go is not criminal but civil in nature”.

Ganito ang naging paliwanag: “The shipowner’s liability for the death of or injuries to passengers resulting from the negligence of the ship captain, with or without concurring negligence on the part of the shipowner, arises from the contract of carriage, hence, civil in nature.”

Ang  kaanak ng mga biktima na karamihan ay hindi pa natatagpuan ay lubhang nalungkot at nagalit sa naturang desisyon.
“Walang katapat na salapi o kabayaran ang buhay ng tao,” sabi ng hepe ng PAO sa ginanap na press conference bago ang martsa ng grupo sa Supreme Court.

The group filed omnibus motion (1) for reconsideration; (2) to submit the case to the SC En Banc; and (3) for rendition of a decision in line with Section 6 (a), Rule 13 of the Internal Rules of the Supreme Court.
Tila naging madali ang sagot sa appeal ni PAO chief para sa mga kamag-anak ng biktima. August 11 sila nagsumite ng appeal sa Supreme Court at noong August 15 thru Solicitor General Francis Jardeleza, inatasan ng gobyerno ang SC para sa re-consideration ng naunang ruling.  (Read http://businessmirror.com.ph/~businfk5/index.php/en/news/regions/37194)

Sa 27-page motion for reconsideration, nakasaad na “the government insisted that there was probable cause to indict respondent Go for the crime of reckless imprudence resulting in multiple homicide, physical injuries and damage to property.”

Noong September 1, inumpisahan ni Sen. Grace Poe ang imbestigasyon sa problema ng MRT sa palagiang aberya sa byahe nito. Nauna rito ay ang paghahain ng batas ng Senador, ang Senate Bill 2266 upang magkaroon ng National Transportation Safety Board “that will investigate and report on air, road, and sea accidents as well as those involving pipeline, railroad, and tracked vehicles.”

Ayon sa senador kailangan ito ng bansa dahil na rin sa “high incidence of transportation-related accidents not to mention the low quality of transport service, high operation costs and inefficient transit system."
Bago ang imbestigasyon, sinubukan ng senador sumakay ng rush hour sa MRT at tulad ng ordinaryong mamamayan ay naranasan nito ang abutin ng halos isang oras sa pila sa kahabaan ng kalye bago nakasakay sa North Edsa station patungong Taft MRT terminal. Nasaksihan niya first hand ang overloading at peligro sa pagsakay sa MRT lalo na sa rush hour.

As of press time, hinihintay ng mga kaanak at supporters ng mga biktima at ng media ang resulta sa motion of reconsideration na isinumite ni Jardeleza na ngayon ay isa nang Associate Justice sa Supreme Court thru the appointment of Pres. Noynoy Aquino on August 20.


Panahon na para paigtingin ng pamahalaan ang kaligtasan ng pampublikong sasakyan at bigyan ng karampatang hustisya ang mga kaanak ng biktima ng faulty transport  system sa bansa. Paigtingin rin sana ng mga transport owners ang kaligtasan ng mga mamamayan na tumatangkilik sa kanila.
